Employment
Our labour practice is one of our long-standing practices. Indeed, our managing partner, Samir Kanaan, advised on the drafting of the U.A.E.’s labour law. We also have a number of advocates and legal consultants who regularly work on labour matters and have advised a number of well-known international and local companies in their labour disputes. Due to our extensive litigation experience, we are deeply familiar with the court precedents and the court’s interpretation of the various labour law provisions. This is an important component of our labour practice, because the U.A.E. labour law allows judges to use their discretion to interpret and apply many of its provisions. Further, given the large expatriate population in the U.A.E., labour disputes often affect the residency status of company employees and their families. We can advise on immigration matters which may arise from labour disputes. In addition to the employment and civil matters associated with employee disputes, there may also be criminal elements. We are experienced in handling employment disputes from both a criminal and a civil perspective. In brief, we are able to advise and represent our clients on a broad range of employment matters, including the following:
- Compliance with local labour laws, regulations and Emiratization requirements;
- The preparation of employment agreements;
- End of service indemnities and pension plans;
- Hiring and recruitment practices;
- Disciplinary actions;
- Employment disputes; and
- Any associated criminal and immigration matters.
